TERMS AND CONDITIONS
The terms and conditions as laid out here form part of the contract between Damerham Trout Fisheries LLP and the client upon confirmation of the booking and to all members of the client party and should be read carefully.
Please ensure client and client party have also read our Risk Assessment under 'HEALTH AND SAFETY' BELOW. Confirmation of the booking is taken as the client and client party being in agreement with these terms and conditions and as having read the risk assessment.
BOOKING
All fishing should be booked in advance. Bookings should be made direct with Damerham Trout Fisheries LLP either by email info@damerhamfisheries.co.uk , in writing Damerham Trout Fisheries LLP The Common, Damerham, Fordingbridge, Hampshire SP6 3HR or by telephone 01725 518446.
RULES OF THE FISHERY
Only fly fishing is allowed at the fishery, using one single hook, maximum size 8.
Dry fly and nymph only may be used on the river. Wet, dry fly and nymph may be used on the lakes.
No litter, radios, or animals.
No wading or swimming.
The management take no responsibility for any circumstances affecting the lake or fishing that are beyond their control.
There is strictly no catch-and-release.
PAYMENT
A Deposit of 50% of the cost of your event should be made at the time of booking. The balance will become due 90 days prior to the date of your event. Extras including extra fish caught and drinks will be invoiced immediately after your event and the account should be settled within 30 days of the invoice date.
We go to every length to ensure that all details shown in all our advertising are correct. We cannot, however, accept liability is due to circumstances beyond our control, the facilities pictured or described are altered or withdrawn.
PRICES
We reserve the right to amend our prices at any time before you book. Once you have booked, the price of your day is fully guaranteed and will not change.
CANCELLATION BY YOU
In the event of cancellation by you, for whatever reason, the following scales of charges is payable:
Prior to 90 working days 50% of total cost.
89-0 working days 100% of total cost. We will however make every effort to re-let and in such an event 50% of the payment will be refunded.
GIFT VOUCHERS
These are non refundable and non transferable. Gift vouchers are valid for two years from the date of purchase.
CANCELLATION OF GIFT VOUCHERS
The original purchaser may cancel a voucher for a full refund within 14 days of purchase.
ALTERATIONS TO CONFIRMED BOOKINGS
If you decide to change any part of your booking after these have been confirmed up to 90 days prior to your event, we will try to assist at an administration charge of £30 per alteration plus any additional costs incurred. Changes or alterations within 90 days of arrival will be treated as a cancellation and cancellation charges will apply.
CANCELLATION BY DAMERHAM TROUT FISHERIES LLP
We reserve the right to cancel any booking. In such a case we will offer an alternative booking of similar value or a full refund of any monies received by us.
CURTAILMENTS AND LIABILITY
Neither Damerham Trout Fisheries LLP nor any person assisting it shall be liable for the consequences of delays or restrictions from adverse weather, obstructions, repairs or damage to lakes, flooding, shortage of water, industrial action, fuel rationing, shortages of or non-availability of fuel or any other cause and reserve the right to restrict the activity if unusual or hazardous conditions prevail. Neither Damerham Trout Fisheries LLP nor any person or company assisting or collaborating with it shall be held liable for the death, personal injury or illness of a client.
HEALTH AND SAFETY
We urge all who fish to wear protective eyewear to prevent accidents. Our experience is that insurance companies will not cover anyone who has not worn protective eyewear and medical advice cautions that eyewear should not be shared. Clients of Damerham Trout Fisheries LLP should make provision for their own medical needs.
Guests are expected to follow the ghillies instructions in respect of the handling, taking and returning of fish, The conduct of guests should be considerate to the enjoyment and safety of others, both on the river bank, in the fishing lodge and lake side fishing huts, provided for guests’ use. Clients of Damerham Trout Fisheries LLP should read these conditions and abide by them. Damerham Trout Fisheries Ghillies/Coaches/Instructors work from 9am until 4.30pm. If you require their services outside these hours then that is by negotiation and we would ask that you reward the Guide for additional hours in addition to any gratuity that you would normally offer. Our Corporate Day price includes outfits, flies, leaders and statutory national rod licence.
All Guides / instructors must be hired through Damerham Trout Fisheries LLP. Freelance fishing guides are not allowed on our waters.
Please ensure the Client and all members of the client party have read the risk assessment.
EQUIPMENT OR GOODS SOLD BY DAMERHAM TROUT FISHERIES LLP
Risk in the goods will pass to you on delivery. Ownerships of goods supplied shall remain vested in DAMERHAM TROUT FISHERIES LLP and shall not pass to you until payment in full for all such items has been made. Equipment supplied during the day at the client’s request will be billed to the same billing address and to the same person as the invoice for the fishing.
HIRED EQUIPMENT
All equipment hired by our clients as part of a corporate day or individually is covered by insurance for malfunction or accidental breakage. Any equipment not returned at the end of the day will be billed at retail price.
Your contract with DAMERHAM TROUT FISHEREIES LLP is governed by English Law and any dispute is to be settled in the English Courts.
